Terms of Service

These Terms of Service ("Terms") govern your use of the Dictately application and related services (the "Service") provided by GIETO GROUP ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Dictately is an AI-powered voice dictation tool for macOS that converts speech to text using advanced speech-to-text technology. The Service includes a desktop application that captures audio, sends it to cloud-based STT providers for transcription, and delivers formatted text directly into your applications.

2. Account Registration

To use certain features of the Service, you must create an account using Firebase Authentication. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Be at least 16 years of age to create an account
• Notify us immediately of any unauthorised use of your account

You are responsible for all activity that occurs under your account.

3. Plans and Pricing

3.1 Free Plan

The Free plan provides access to core dictation features with a limit of 2,000 words per month. Once the limit is reached, dictation will be paused until the next billing cycle.

3.2 Pro Plan

The Pro plan provides unlimited dictation and access to all premium features. Pro subscriptions are billed monthly via Stripe. You may cancel at any time; your access continues until the end of the current billing period.

3.3 Price Changes

We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect your current billing period.

4. Acceptable Use

You agree not to use the Service to:

• Generate, transmit, or store content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Abuse, overload, or interfere with the Service or its underlying APIs
• Attempt to reverse-engineer, decompile, or disassemble the software
• Use automated tools to excessively or abusively access the Service
• Impersonate any person or entity, or misrepresent your affiliation
• Circumvent usage limits, authentication, or security measures

We reserve the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

5.1 Your Content

You retain full ownership of all transcriptions and text generated through the Service. We claim no rights over your content.

5.2 Our Software

The Dictately application, including its code, design, branding, and documentation, is owned by GIETO GROUP and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the software for its intended purpose.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• Transcriptions will be 100% accurate at all times
• The Service will be uninterrupted, timely, or error-free
• The Service will meet your specific requirements
• Any errors in the software will be corrected

7. Limitation of Liability

To the maximum extent permitted by applicable law, GIETO GROUP and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

Either party may terminate the use of the Service at any time:

• You may delete your account at any time through the application or by contacting us
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your account data will be deleted upon request
• Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via the email address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
